Nothing on this Site creates a construction contract, service agreement, or warranty. All project-specific rights and obligations are governed solely by a written estimate, proposal, or contract accepted by the customer.

If there is any conflict between this Site and the written agreement, the written agreement controls.
4.3 Changes Due to Site Conditions
Estimates are based on visible and disclosed conditions at the time of inspection or estimate. Unforeseen or hidden conditions may require changes to the scope of work and pricing, as described in Section 6 below.
5. DEPOSITS & PAYMENTS
5.1 Deposits
Some projects may require a deposit before scheduling or starting work. The amount and timing of any deposit will be stated in your written estimate or contract.
5.2 Payment Terms
Payment schedules, accepted payment methods, and due dates are defined in your written estimate or contract. Failure to make payments when due may result in work stoppage, rescheduling, or additional charges as permitted by the agreement and applicable law.
5.3 Project-Specific Terms
Deposit requirements, payment schedules, and any cancellation or rescheduling fees may vary by project. In all cases, the customer’s signed or otherwise accepted written estimate or contract controls.
6. PROJECT CHANGES & ADDITIONAL WORK
6.1 Customer-Requested Changes
If you request changes to the scope of work after an estimate is accepted (for example, adding areas, changing materials, or altering design), Apex may issue a revised estimate or change order. Additional work will be performed only after approval and may result in additional charges and schedule changes.
6.2 Unforeseen Conditions & Extra Work
Unforeseen site conditions, underground conditions, drainage issues, unsuitable base or subgrade, hidden deterioration, utility conflicts, code or permit requirements, or other conditions discovered after work begins may require additional work, materials, or changes to the planned scope. When applicable, Apex will seek customer authorization for additional work and related charges. If the customer declines necessary additional work, Apex may suspend or terminate work to avoid unsafe or non-compliant conditions.
7. SCHEDULING & WEATHER DELAYS
7.1 Scheduling
Any start dates, completion dates, or timeframes provided are estimates only and are not guaranteed unless expressly stated in the written contract.
7.2 Weather & Other Delays
Project schedules and completion dates may change due to weather, temperature, moisture, material availability, inspections, permits, site conditions, equipment issues, labor availability, or other circumstances outside Apex’s reasonable control. Such delays do not constitute a breach of contract.
7.3 Rescheduling
If a project must be rescheduled, Apex will make reasonable efforts to complete the work as soon as practical under the circumstances.
8. PERMITS & CODE COMPLIANCE
8.1 Responsibility for Permits
Responsibility for obtaining permits will be stated in your written estimate or contract. In some cases, Apex may assist with or obtain permits; in other cases, the property owner may be responsible.
8.2 Compliance with Laws
Work will be performed in a manner intended to comply with applicable building codes and regulations based on the information available to Apex. Changes in code interpretation, inspection requirements, or other regulatory issues may require additional work or modifications, which may result in additional charges.
8.3 Utility Locations
Unless otherwise stated in writing, the property owner is responsible for identifying and marking private utilities and underground features not covered by public utility locating services.
9. WARRANTIES & LIMITATIONS
9.1 Project-Specific Warranties
Any warranties on workmanship or materials will be described in your written estimate or contract. Warranty terms, coverage, and duration may vary by project, material type, and scope of work.
9.2 Exclusions
Warranties generally do not cover damage or defects caused by:
- Improper use, overloading, or misuse of surfaces
- Lack of maintenance or improper maintenance
- Tree roots, ground movement, or settlement
- Freeze-thaw cycles, de-icing chemicals, or weather-related damage
- Acts of third parties, vehicles, or equipment beyond normal residential or commercial use
- Acts of God or events beyond Apex’s control
9.3 Written Agreement Controls
If there is any conflict between this Site and the warranty terms in your written agreement, the written agreement controls.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Apex and its owners, employees, and subcontractors are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of this Site or the performance of work, even if advised of the possibility of such damages.
To the extent Apex is found liable for any claim related to work performed, such liability will be limited to the amount actually paid by the customer to Apex for the specific project giving rise to the claim, unless a different limitation is stated in the written contract or required by law.
11. GOVERNING LAW – ILLINOIS
These Terms & Conditions, and any dispute arising out of or relating to this Site or any services provided by Apex, are governed by the laws of the State of Illinois, without regard to its conflict of law principles. Any legal action shall be brought in the state or federal courts located in Illinois, to the extent permitted by law.
